A ..."Forcible eviction was necessitated"<br /><br />A landlord cannot forcibly evict a tenant without proper notice. The landlord must provide written notice to the tenant of the DEFAULT. If the tenant does not fix the default within a reasonable amount of time, the landlord must file for a formal court eviction proceeding. <br /><br />What about the three day eviction notice? Was the snake properly served? <br /><br />If the landlord did not provide sufficient notice prior to filing a court action or did not correctly deliver or serve the notice to the tenant, the tenant may have a defense to the eviction, even if the tenant has not paid the required rent. Both are non-venomous...but the rat snake may be a good one to keep around, Chief. After all, it does eat other snakes.<br /><br />BTW, if that had been a prank...it would have been a good one.
